1. Who can use Mind Spark
You must be at least 13 years old to create an account. If you are between 13 and the age of majority where you live, you should review these Terms with a parent or guardian. See our Children & Teen Safety page for the protections that apply to younger accounts.
You are responsible for keeping your login credentials secure and for activity that happens under your account.
2. Your content and the licence you grant
You keep ownership of the challenges, reels, images, comments and other content you post ("your content"). To operate the service we need permission to host and display it.
By posting, you grant Vymeros a worldwide, non-exclusive, royalty-free licence to store, reproduce, adapt (for formatting, thumbnails, share cards and previews), publicly display and distribute your content in connection with operating and promoting Mind Spark. This licence ends when you delete the content, except for copies already shared by others, cached copies, and copies retained for legal or safety reasons.
You confirm you have the rights to everything you upload, including images, video, audio and puzzle material created by other people.
3. Acceptable use
You agree not to:
- Post illegal, hateful, harassing, sexual, violent or exploitative content.
- Upload content that infringes someone else's copyright, trademark or privacy.
- Impersonate another person, brand or Mind Spark staff.
- Manipulate points, streaks, leaderboards, votes or referrals through bots, multiple accounts or automation.
- Scrape, reverse engineer, overload or attempt to bypass access controls of the service.
- Use the app to collect personal information about other users or to send spam.
Our Community Guidelines describe these rules in more practical detail and form part of these Terms.
4. Points, levels, streaks and rewards
Points, XP, levels, badges, streaks and leaderboard positions are in-app features with no monetary value. They cannot be purchased, sold or exchanged, and we may adjust, reset or recalculate them — for example to correct bugs or to remove results gained by cheating.
5. AI features
Mind Spark includes AI-assisted features such as script help and AI video generation. Output can be inaccurate or unexpected. You are responsible for reviewing anything you publish. Details are on our AI Content Disclosure page.
6. Moderation, suspension and termination
We may remove content, limit visibility, restrict features, or suspend or terminate accounts that breach these Terms or our Guidelines, or where we reasonably believe action is needed to protect users. Where practical we tell you why and offer a way to respond.
You can stop using Mind Spark and delete your account at any time.
7. Third-party services and links
The app relies on third-party infrastructure (hosting, authentication, storage, analytics and AI providers) and may link to external sites. We are not responsible for third-party content or policies.
8. Disclaimers
Mind Spark is provided "as is". Challenges, IQ-style tests, eye tests and brain games are for entertainment. They are not psychological, medical, educational or diagnostic assessments and should not be relied on as such.
We do not guarantee that the service will be uninterrupted, error-free, or that content will always be accurate or available.
9. Limitation of liability
To the maximum extent allowed by applicable law, Vymeros is not liable for indirect, incidental, special or consequential damages, or for loss of data, points or content. Nothing here limits rights you have under consumer protection law in Canada, the United States or your place of residence that cannot legally be limited.
10. Changes to these Terms
We may update these Terms as the product changes. When changes are significant we will update the date at the top of this page and, where appropriate, notify you in the app. Continuing to use Mind Spark after an update means you accept the revised Terms.
11. Governing law and contact
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules, except where mandatory local law in your jurisdiction applies instead.
