Terms of Service

You must be at least 13 years old to create a Mind Spark account. If you are between 13 and the age of majority where you live, you should review these Terms with a parent or guardian. Accounts we believe belong to someone under 13 are removed. See Children & Teen Safety for details.

You may not use Mind Spark if you are barred from doing so under applicable law or if we have previously terminated your account.

• You create an account with an email and password, or with Google sign-in.
• Give accurate information and keep your email address current so we can reach you.
• Keep your credentials private. You are responsible for activity under your account.
• One person, one account. Do not sell, rent or transfer your account.
• Tell us immediately at support@vymeros.com if you suspect unauthorised access.

• Follow these Terms and the Community Guidelines everywhere in the app.
• Only upload content you have the right to upload.
• Respect other people's privacy, safety and intellectual property.
• Do not use the app to break the law or to harm anyone.
• Do not interfere with the service, its security, or other people's use of it.

You keep ownership of everything you post — challenges, reels, videos, photos, comments, polls, community posts and captions ("your content"). To run the service we need permission to host and display it.

By posting, you grant Vymeros a worldwide, non-exclusive, royalty-free licence to store, reproduce, adapt (for formatting, thumbnails, share cards and previews), publicly display and distribute your content in connection with operating and promoting Mind Spark. This licence ends when you delete the content, except for copies already shared by others, cached copies, and copies retained for legal or safety reasons.

You confirm you hold the rights to everything you upload, including images, video, audio, music and puzzle material created by other people.

Reels are short vertical videos you record or upload, optionally with camera effects, sound, stickers and interactive polls or quizzes. Reels are public to other users unless removed. You are responsible for everyone appearing in your reels — film people only with their permission, and never film minors in a sexualised, dangerous or exploitative way.

Music and sounds available in the Sound Studio may only be used inside Mind Spark. Do not upload audio you do not have rights to.

Challenges include quizzes, puzzles, polls, duels, daily sparks, speed rounds and multi-day social challenges. Challenges you create are published to other users and must be accurate, safe and lawful.

• Never publish a challenge that instructs people to do something dangerous, illegal or self-harming.
• Health, fitness, food and wellness challenges are general entertainment, not medical or professional advice.
• Do not manipulate results, answers, points, streaks, votes, duels or leaderboards through bots, scripts or multiple accounts.
• Points, XP, levels, badges and streaks have no monetary value and may be adjusted, reset or recalculated — for example to fix bugs or remove cheating.

Comments on challenges, reels and community posts must follow the Community Guidelines. Comments are public. We may remove comments, limit their visibility, or restrict your ability to comment if they breach these Terms.

Likes, reactions, follows, votes and views are signals used to rank content and calculate leaderboards. Artificially inflating them — with bots, engagement pods, automation or duplicate accounts — is a breach of these Terms and may cost you your account.

Mind Spark generates share links, preview cards and invitations so you can send content to other apps and to friends. When you share, you are responsible for where you share and for respecting the privacy of anyone shown in the content. Do not remove attribution or present someone else's Mind Spark content as your own.

Saved reels, saved challenges and your Library are a convenience feature tied to your account. Saving does not give you rights over the creator's content, and saved items may disappear if the creator deletes them or if we remove them for a policy breach.

Camera drafts are stored on your own device (in your browser's local storage) until you publish them. Clearing browser data, uninstalling the app or using another device can delete drafts permanently. We cannot recover a lost local draft. Drafts you upload to your account are stored on our infrastructure and deleted when you delete them or your account.

Do not post, upload, stream or link to content that:

• Sexually exploits, endangers or sexualises a minor in any way.
• Contains pornography, sexually explicit material or non-consensual intimate imagery.
• Promotes hate against people based on race, ethnicity, national origin, religion, caste, disability, disease, sex, gender identity, sexual orientation or immigration status.
• Depicts or glorifies graphic violence, gore, animal cruelty or terrorism.
• Encourages suicide, self-harm, disordered eating, or dangerous 'challenges' that risk injury.
• Promotes illegal drugs, weapons, trafficking or other criminal activity.
• Infringes copyright, trademark, publicity or privacy rights.
• Contains malware, phishing links, or misleading redirects.
• Reveals someone's private information without their consent.

• Harassment and bullying — targeted insults, pile-ons, sexual harassment, unwanted contact, threats or degrading content about a person.
• Fraud and scams — fake giveaways, phishing, investment or crypto scams, payment fraud, or any attempt to trick users out of money or data.
• Impersonation — pretending to be another person, brand, creator or Mind Spark staff, or running a parody account that is not clearly labelled.
• Spam — bulk or repetitive posting, engagement farming, follow/unfollow automation, bots, mass unsolicited messages, or link dumping.
• Illegal activity — using Mind Spark to commit, plan, promote or facilitate any crime.
• Platform abuse — evading bans, running multiple accounts to manipulate rankings, scraping, reverse engineering, or attacking our infrastructure.

Mind Spark, the Vymeros name, logo, design system and software are owned by Vymeros and protected by intellectual property laws. You get a personal, revocable, non-transferable licence to use the app; you get no rights in our brand.

We respond to valid copyright complaints and repeat-infringer accounts are terminated. The full notice-and-counter-notice process is on our Copyright & Intellectual Property page.

We use a combination of user reports, automated signals and human review. We may remove content, reduce its distribution, add a warning, restrict features, or suspend an account where we reasonably believe these Terms or the Guidelines have been breached, or where action is needed to protect users. Where practical we tell you what happened and how to appeal.

Every reel, video, photo, challenge, comment, community post and profile has a Report option, and you can block any user from their profile. Blocking hides that person's content from your feeds and stops them interacting with you. See Safety & Reporting for the full list of report reasons and what happens next.

• We may warn, restrict, suspend or permanently ban accounts that breach these Terms.
• Severe breaches — child safety, credible threats, sexual exploitation, coordinated fraud — result in immediate permanent removal without warning.
• We may also suspend accounts where required by law or to protect the service.
• You can appeal a decision by emailing support@vymeros.com from the address on your account.

You can delete your account yourself at any time from Account & Data Deletion or Profile → Settings → Privacy & Safety. Deletion is permanent: your profile, uploads, comments, likes, saves, follows, points, levels and streaks are removed or irreversibly anonymised, and you are signed out on every device.

The app relies on third-party infrastructure (hosting, authentication, storage, email, analytics and AI providers) and may link to external sites. We are not responsible for third-party content or policies.

Mind Spark is provided "as is" and "as available". Challenges, IQ-style tests, eye tests and brain games are for entertainment. They are not psychological, medical, educational or diagnostic assessments and must not be relied on as such. Fitness, food and wellness content is general information, not professional advice.

We do not guarantee that the service will be uninterrupted, secure or error-free, or that user content will be accurate or always available.

To the maximum extent allowed by applicable law, Vymeros is not liable for indirect, incidental, special, punitive or consequential damages, or for loss of data, content, points or goodwill, arising from your use of Mind Spark. Nothing here limits rights you have under consumer protection law in Canada, the United States or your place of residence that cannot legally be limited.

We may update these Terms as the product changes. When changes are significant we update the date at the top of this page and, where appropriate, notify you in the app. Continuing to use Mind Spark after an update means you accept the revised Terms.

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules, except where mandatory local law in your jurisdiction applies instead.
