What you may upload
- Media you created yourself.
- Media you have a licence or written permission to use, within the terms of that licence.
- Public-domain or openly licensed media, used according to its licence terms.
- Sounds provided inside the Mind Spark Sound Studio, used only inside Mind Spark.
Attribution alone is not permission. "Found it online", "no copyright intended" and "credit to the owner" are not defences.
Our intellectual property
The Mind Spark and Vymeros names, logos, design system, official challenge sets, UI, code and generated share cards belong to Vymeros. You may not copy, resell, rebrand or reverse engineer them, or use our marks in a way that suggests endorsement.
Filing a copyright complaint
If you own a copyright (or are authorised to act for the owner) and believe content on Mind Spark infringes it, email support@vymeros.com with the subject "Copyright complaint" and include all of the following:
- Your full legal name, postal address, email address and phone number.
- A description of the copyrighted work you say has been infringed.
- The exact link(s) to the Mind Spark content you want removed, plus screenshots if helpful.
- A statement that you have a good-faith belief the use is not authorised by the owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act on the owner's behalf.
- Your physical or electronic signature.
Incomplete notices may delay processing. Knowingly filing a false claim can create legal liability.
What we do with a complaint
- We review the notice and, where it is valid and complete, remove or disable access to the content.
- We notify the person who uploaded it and tell them what was removed and why.
- We record the removal against that account for repeat-infringement purposes.
- We aim to act promptly; complex claims can take longer.
Counter-notice
If your content was removed and you believe that was a mistake or that you are authorised to use the material, email support@vymeros.com with the subject "Copyright counter-notice" and include:
- Your name, address, email and phone number.
- Identification of the removed content and where it appeared.
- A statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification.
- Your consent to the jurisdiction of the courts where you reside (or Ontario, Canada if you are outside Canada), and your agreement to accept service of process from the complainant.
- Your physical or electronic signature.
We may share your counter-notice with the original complainant. If they do not pursue a legal action, we may restore the content.
Repeat infringers
Accounts that receive repeated valid copyright complaints are restricted and then permanently terminated. Attempting to re-upload removed content or to evade a strike with a new account also results in termination.
Trademark, publicity and other rights
For trademark misuse, impersonation of a brand, or use of your name, image or voice without consent, email support@vymeros.com with the subject "Legal inquiry" and describe the right you hold and the content involved.
